Richmond Carter Ltd — Fees & Charges
v1.1 • Applies to Mileage Allowance claims and HRP / State Pension underpayment work
This page explains our fees in plain English. Your fee depends on the type of claim you instruct us to handle.
We do not charge any fees upfront. If your claim does not result in a payment to you, you pay £0 (No Win, No Fee).
1. Quick fee summary
| Service | How the fee is charged | Our fee (plus VAT) |
|---|---|---|
| Mileage Allowance claims | Usually deducted before we pay you (nominee). If HMRC pays you directly, we invoice you. | 40% + VAT (VAT currently 20%; total currently 48%) Minimum fee: £25 (inc. VAT) |
| HRP / State Pension underpayment work | DWP pays arrears directly to you. You pay our fee after you receive arrears (within 14 days). | 30% + VAT (VAT currently 20%; total currently 36%) No minimum fee |
All examples on this page assume VAT at 20%. VAT rates can change. If VAT changes, the total payable changes accordingly.
2. Mileage Allowance claims — 40% + VAT (minimum £25 inc. VAT)
This applies to Mileage Allowance and related employment expense claims that result in an HMRC refund/payment.
2.1 What you pay
- Success fee: 40% of the refund amount, plus VAT at the prevailing rate (VAT is currently 20%, so the total is currently 48%).
- Minimum fee: £25 (including VAT). If the refund is below £25, we retain the full refund amount as our fee.
- If there is no refund, you pay £0.
2.2 How you are paid (nominee payments)
- For Mileage claims, you appoint Richmond Carter as your nominee to receive any HMRC refund where nominee repayment is used.
- We then pay you the balance after deducting our fee and VAT.
- Before releasing any refund, we may request ID, proof of address and bank details (to protect customers and prevent fraud).
- We send you a breakdown showing: refund received, our fee, VAT, and the amount due to you.
2.3 If HMRC pays you directly (Mileage)
- If HMRC pays your refund directly to you instead of paying us as nominee, we will invoice you for our fee and VAT, with a clear breakdown.
2.4 Examples (Mileage)
- Example A — £100 refund: Fee = £40; VAT (20% of £40) = £8; total fee = £48; you receive £52.
- Example B — £30 refund (minimum fee applies): Minimum fee = £25 (inc. VAT); you receive £5.
2.5 Unclaimed funds and re-issue fee (Mileage)
- If we hold funds for you (for example, because we cannot verify details or cannot reach you), we will attempt to contact you after 48 hours, 14 days and 1 month, and may continue attempts for up to 12 months.
- After reasonable attempts and a reasonable period, unclaimed funds may be donated to charity.
- If you contact us later, we will assist you in recovering the amount where possible.
- A £19.99 re-issue fee may apply if a payment needs to be re-sent (unless the need to re-send is due to our error).
3. HRP / State Pension underpayment work — 30% + VAT (charged after you receive arrears)
This applies to work relating to Home Responsibilities Protection (HRP) / National Insurance record correction that results in backdated arrears paid to you by DWP (for example, State Pension arrears and any linked Pension Credit arrears).
3.1 Important — how HRP arrears are paid
- For HRP-related cases, any arrears are paid by DWP directly to you.
- HMRC/DWP will not make HRP arrears payments to Richmond Carter (or any agent) on your behalf.
3.2 What counts as “successful”
- A claim is successful only if it results in backdated arrears paid to you as a result of the HRP correction.
- We do not charge any fee on ongoing weekly/monthly State Pension increases or ongoing Pension Credit — only on backdated arrears actually paid.
3.3 Our fee (HRP)
- Success fee: 30% of the arrears you actually receive, plus VAT at the prevailing rate (VAT is currently 20% on our fee).
- In practice, at today’s VAT rate, the total you pay is currently 36% of the arrears you actually receive.
- No upfront fees. If no arrears are paid, you pay £0.
- No minimum fee applies to HRP arrears.
3.4 Deductions (set-off)
- If DWP makes deductions from arrears to repay a debt (sometimes called a “set-off”), we calculate our fee based on the net arrears you actually receive after those deductions.
3.5 Example (HRP)
- If DWP pays £2,000 in arrears and £300 is set off to settle a debt, the net arrears received are £1,700.
- Fee (30%): 30% of £1,700 = £510; VAT (20% of £510) = £102; total fee = £612 (currently 36% of £1,700).
- You keep: £1,700 – £612 = £1,088.
3.6 When and how you pay (HRP)
- If DWP pays you arrears, we will send you an invoice and a clear breakdown showing how the fee is calculated.
- You agree to pay our success fee within 14 days of receiving the arrears payment.
- To ensure accurate calculation, we may ask you to share the DWP arrears breakdown letter/award notice (or other reasonable evidence of the amount paid and any deductions).
3.7 If payment is late
- If payment is late, we will send reasonable reminders. If you have questions or need more time, contact us and, where appropriate, we can agree a payment plan.
- If there is still no engagement after reminders, we may take formal steps to recover the outstanding fee as a last resort, acting fairly and proportionately and taking account of vulnerability.
